At PictoNexo, we respect the privacy of our users and consider the protection of personal information especially important in an augmentative and alternative communication (AAC) application.

This Privacy Notice describes PictoNexo's current practices regarding the processing of personal data.

Currently, PictoNexo is designed to function without requiring users to create an account, register, or provide personal information to the person responsible for the application.

1. Data Controller

Victor Hugo Perez Marquez, responsible for the operation and distribution of PictoNexo, domiciled in Chihuahua, Chihuahua, Mexico, is the data controller for purposes of this Privacy Notice.

2. About PictoNexo

PictoNexo is an augmentative and alternative communication (AAC) application designed to facilitate expression and communication through pictograms, words, phrases, sounds, audio, and other visual or auditory tools.

The application is designed so that it can be used without requiring the user to provide personal information to the person responsible for PictoNexo.

3. PictoNexo Does Not Currently Collect Personal Data Through the Application

In its current version, PictoNexo does not collect, transmit, or store users' personal data on its own servers during normal use of the application.

Currently, users are not required to:

  • Create an account.
  • Register.
  • Provide their name.
  • Provide an email address.
  • Provide a telephone number.
  • Provide a physical address.
  • Provide medical information.
  • Provide information regarding diagnoses or health conditions.

PictoNexo also does not currently operate its own system intended to individually identify people who use the application.

4. We Do Not Use User Tracking Systems

In the current version of PictoNexo, we do not use our own technologies intended to individually track user behavior within the application.

PictoNexo currently does not use personal information to:

  • Create user profiles.
  • Perform advertising tracking.
  • Display personalized advertising.
  • Sell user information.
  • Track users across applications or websites.
  • Determine the user's physical location.
  • Identify which pictograms or phrases are used by a specific person.

5. Information Stored Only on the Device

Certain PictoNexo features may require information to be stored directly on the device in order to preserve the application's settings and functionality.

Depending on the features used, this locally stored information may include:

  • Configuration preferences.
  • Selected language.
  • Pictogram organization.
  • Favorites.
  • Quick phrases.
  • Accessibility settings.
  • Personalized content created or selected by the user, when such functionality is available.

This information remains only on the user's device and is not transmitted to Victor Hugo Perez Marquez or stored on PictoNexo servers.

The person responsible for PictoNexo cannot remotely access phrases, pictograms, favorites, settings, or any other information stored exclusively on the user's device.

6. Local Photographs, Images, and Recordings

When PictoNexo allows users to add photographs, images, personalized pictograms, or voice recordings, such content may be stored exclusively on the user's device.

PictoNexo does not receive, copy, or remotely store such content on its servers while the application continues to operate under the local-storage model described in this Privacy Notice.

The person responsible for PictoNexo cannot remotely view or listen to personalized content stored exclusively on the user's device.

7. Phrases and Communications Created with PictoNexo

Words, pictograms, phrases, or expressions created by the user within PictoNexo are not sent to the person responsible for the application.

PictoNexo does not currently maintain a remote history of communications created through the application.

When a phrase or setting is stored locally on the device, such information remains under the control of the user and the device.

8. Sensitive Personal Data

PictoNexo does not request or collect medical diagnoses, clinical records, genetic information, biometric information, or other sensitive personal data through the application as a condition for using its communication features.

Due to the nature of an AAC application, content that a user, parent, guardian, or caregiver chooses to create locally could reveal information related to health, disability, communication needs, or other personal circumstances.

When such content remains exclusively on the device, PictoNexo does not receive or remotely store that information.

9. Use by Minors

PictoNexo may be used by minors due to the nature of its communication-support features.

The application does not ask minors to create an account or provide their name, email address, location, diagnosis, or other personal data in order to use PictoNexo's basic features.

When PictoNexo is used by a minor, we recommend that its installation and configuration be performed or supervised by a parent, guardian, caregiver, or responsible adult.

We also recommend avoiding the submission by email of medical information, photographs, documents, or other sensitive information concerning minors unless it is strictly necessary to address a specific support request.

10. Information Voluntarily Provided by Email

Although PictoNexo does not collect personal data through normal use of the application, a person may voluntarily choose to contact us at:

In such cases, we may receive information that the person voluntarily chooses to provide, such as:

  • Their email address.
  • The name associated with their email account, when visible.
  • The contents of their message.
  • Files or information they voluntarily attach.

This information will be used exclusively to:

  • Respond to the inquiry received.
  • Provide technical support.
  • Address comments, suggestions, or reports.
  • Resolve matters related to PictoNexo.
  • Handle requests related to privacy or personal data protection.

We will not use information received through this channel to create advertising profiles, nor will we sell it to third parties.

11. Retention of Support Communications

Communications voluntarily sent to contact@pictonexo.com may be retained for the period reasonably necessary to address the request, maintain a record relating to its resolution, or comply with legal obligations where applicable.

When retention is no longer necessary, such communications may be deleted in accordance with applicable procedures.

12. Distribution Platforms

PictoNexo may be distributed through third-party platforms such as the Apple App Store or Google Play.

These platforms may collect certain information directly in accordance with their own terms, policies, and privacy notices.

Processing performed directly by Apple, Google, the device manufacturer, or the operating system provider is independent from processing carried out by PictoNexo and is subject to the policies of those third parties.

13. Third-Party Services

PictoNexo may use technological components necessary for its operation on Android, iOS, or other operating systems.

This does not mean that PictoNexo automatically provides users' personal information to such third parties.

If a future version incorporates a service that collects or transmits information from the application, this Privacy Notice will be updated before or at the time such processing is implemented, as appropriate.

14. Advertising

PictoNexo currently does not use users' personal data for personalized advertising.

PictoNexo does not sell or commercialize personal information obtained through the application.

15. Data Transfers

Because the current version of PictoNexo does not collect personal data through normal use of the application, we do not transfer such data resulting from use of the application.

Information voluntarily provided by a person through email will not be sold or used for purposes other than those stated in this Privacy Notice, except where there is a legal obligation to do so or where it is necessary to address the person's own request.

16. Uninstalling the Application and Local Data

Information stored exclusively on the device remains under the user's control.

Depending on the operating system and the available features, the user may delete certain information from within the application or through the application's storage and management options provided by the device.

Uninstalling PictoNexo may result in the deletion of locally stored information.

Because the person responsible for PictoNexo does not receive or remotely retain such information, it cannot be recovered or deleted remotely when it exists exclusively on the user's device.

17. ARCO Rights

When Victor Hugo Perez Marquez is in possession of personal data voluntarily provided by an individual, for example through a communication sent to contact@pictonexo.com, the data subject may exercise the following rights:

  • Access: request information regarding personal data that we may hold about them.
  • Rectification: request correction of inaccurate or incomplete data.
  • Cancellation: request deletion of their personal data where legally appropriate.
  • Objection: object to certain processing where legally appropriate.

18. Procedure for Exercising ARCO Rights

The data subject or their legal representative may submit a request to:

The request should include the information reasonably necessary to identify the requester, locate the relevant information, and determine which right they wish to exercise.

When necessary to protect personal information, we may request documentation or additional information to verify the identity of the data subject or their legal representative.

Requests will be handled in accordance with the time limits and procedures established by applicable Mexican law.

19. Limitation of Use or Disclosure

When we are in possession of personal data voluntarily provided by an individual, the data subject may request limitation of its use or disclosure where legally appropriate.

20. Withdrawal of Consent

When the processing of personal data is based on the consent of the data subject, they may request withdrawal of such consent in the cases and under the conditions established by applicable law.

21. Security

When PictoNexo is in possession of personal information voluntarily provided through direct communication, reasonable measures will be adopted to protect it against loss, alteration, unauthorized access, use, or disclosure.

No electronic system can guarantee absolute security.

22. Future Changes to How PictoNexo Works

The practices described in this Privacy Notice correspond to PictoNexo's current operation.

If PictoNexo introduces features in the future such as:

  • User accounts.
  • Synchronization between devices.
  • Cloud backups.
  • Remote storage of pictograms or settings.
  • Online services associated with a user.
  • Usage analytics.
  • Personalization services based on user information.
  • Features that transmit photographs, audio, phrases, or other content outside the device.

this Privacy Notice will be updated to clearly explain what information is collected, why it is used, where it is stored, and, where legally required, to obtain the necessary consent.

23. Changes to this Privacy Notice

This Privacy Notice may be modified as a result of legal changes, new features, technological changes, or modifications to PictoNexo's practices.

New versions may be identified by a version number and their update date.

Changes may be communicated through:

  • The PictoNexo application.
  • The official PictoNexo website.
  • An in-app notification, where applicable.

24. Previous Versions

PictoNexo may retain previous versions of this Privacy Notice for historical, transparency, and legal compliance purposes.

25. Applicable Law

This Privacy Notice shall be interpreted in accordance with the applicable laws of the United Mexican States concerning the protection of personal data held by private parties.

27. Summary of Our Current Privacy Practices

In the current version of PictoNexo:

  • No account creation is required.
  • No personal data is required in order to use the application.
  • We do not store user profiles on PictoNexo servers.
  • We do not receive phrases created by the user.
  • We do not receive users' personalized pictograms.
  • We do not receive users' locally stored photographs or recordings.
  • We do not individually track user activity within the application.
  • We do not sell personal data.
  • We do not use sensitive personal data for advertising.

The only personal information we may directly receive under current conditions is information that a person voluntarily chooses to provide when contacting us, for example by email.

28. Effective Date

This Privacy Notice becomes effective on September 10, 2026.
